Terms of Service

These Terms of Service (the “Terms”) govern your use of the Lingle voice-based language tutoring service at lingle.ai and related applications (the “Service”), operated by Lingle (“Lingle”, “we”, “us”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. The Service
Lingle is a voice-based language tutoring product powered by artificial intelligence. The Service generates lesson plans, conducts spoken conversations with you, and tracks your progress over time. The Service is provided on an as-is basis and may change as we improve it.
2. Eligibility and accounts
You must be at least 13 years old to use the Service. If you are between 13 and 18 (or the age of majority where you live), you may only use the Service with the consent of a parent or guardian who agrees to these Terms on your behalf.
You are responsible for the accuracy of the information you provide, for keeping your account credentials secure, and for any activity that takes place under your account. Notify us immediately if you suspect unauthorized use.
3. Subscriptions, billing, and trials
Lingle offers a paid subscription (“Lingle Pro”) billed monthly through Stripe. Pricing is shown on the Service before checkout and may include a free trial period at our discretion. If you start a free trial, you will not be charged until the trial ends. You can cancel at any time before the trial ends to avoid being charged.
New accounts may receive a limited free experience (for example, one introductory lesson) before being asked to subscribe. The extent of any free tier is at our discretion and may change.
Subscriptions renew automatically each billing period unless cancelled. You can cancel at any time from the billing portal accessible through your account settings; cancellation takes effect at the end of the current billing period and you retain access until then. Except where required by law, payments are non-refundable.
We may change our prices. We will give reasonable notice before any price change takes effect for your subscription, and the new price will apply from your next renewal.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose, or to harass, abuse, or harm another person.
- Reverse engineer, scrape, or attempt to extract the underlying models, prompts, or training data.
- Share your account credentials, or resell or sublicense access to the Service without our written permission.
- Interfere with or disrupt the Service, our infrastructure, or other users.
- Upload or transmit malware, or attempt to circumvent any rate limits or access controls.
- Use the Service to generate content that is illegal, sexually explicit involving minors, or that violates third-party rights.
We may suspend or terminate accounts that violate these rules.
5. Your content
You retain ownership of the speech, text, and other content you submit to the Service (“User Content”). By using the Service, you grant Lingle a worldwide, royalty-free license to process, transmit, store, and display your User Content as needed to operate the Service for you, including by sending it to the third-party providers listed in our Privacy Policy.
We may use aggregated and de-identified data derived from User Content to improve the Service. We do not use your User Content to train third-party foundation models.
6. AI-generated output
Lessons, corrections, translations, and other tutor responses are generated by AI. They may contain mistakes, omissions, or culturally inappropriate suggestions. Do not rely on the Service for medical, legal, financial, or other professional advice. Always verify important information against an authoritative source.
7. Our intellectual property
The Service — including the software, design, branding, lesson plans, generated content delivered to you, and all related materials (other than your User Content) — is owned by Lingle and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial language learning.
8. Third-party services
The Service relies on third-party providers (listed in our Privacy Policy) for hosting, AI models, speech processing, payments, and email delivery. Their availability and behavior is outside our control. We are not responsible for outages or actions of these providers, but we will work to keep the Service running smoothly.
9. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied. To the fullest extent permitted by law, Lingle disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising out of course of dealing or usage of trade.
We do not warrant that the Service will be uninterrupted, error-free, secure, or that it will produce specific learning outcomes.
10. Limitation of liability
To the fullest extent permitted by law, Lingle and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Service.
Our total liability for any claim arising out of or relating to the Service or these Terms is limited to the greater of (a) the amount you paid Lingle in the twelve months preceding the claim, or (b) USD $100.
11. Indemnification
You agree to indemnify and hold harmless Lingle from any claims, losses, liabilities, damages, and expenses (including reasonable attorney’s fees) arising out of your User Content, your use of the Service, or your violation of these Terms.
12. Termination
You can stop using the Service at any time and delete your account from settings or by contacting us. We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and dispute resolution) will continue to apply.
13. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in California, and you and we consent to the exclusive jurisdiction of those courts, except that either party may seek injunctive relief in any court of competent jurisdiction.
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or via a notice in the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
